We
recently handled a case involving
a woman who had a large mass
on her left breast when she
was examined at a major hospital.
Despite finding the mass, the
physician ordered only a screening
mammogram of both breasts.
About a month later, the patient
was sent for a diagnostic mammogram
of the left breast. A radiologist
determined that the mass was "probably
benign" and told her to return
in six months. Neither the
initial physician nor the radiologist
ordered a biopsy or sonogram
of the mass. Several months
later, the patient went to
another medical facility, where
doctors performed a biopsy
and determined she had breast
cancer. The patient underwent
a mastectomy, chemotherapy,
radiation and plastic surgery.
When the client finally contacted
us we were able to immediately
help her. The failure of the
first physicians to diagnose
her permitted the tumor to
grow and spread to 13 lymph
nodes, significantly decreasing
her chances of survival. After
two weeks in trial, a jury
awarded the patient $2.3 million.
